Terms of use
These terms apply to the NOT READY iPhone app and the youarenotready.app website, provided by Psyche Vibes Ltd, a company registered in England and Wales (company number 17229667) ("we", "us"). By using NOT READY you agree to them. If you do not agree, please do not use the app.
Who can use it
You must be at least 16 years old to use NOT READY. By using it, you confirm that you are not located in a country subject to a US government embargo and are not on any US government list of prohibited or restricted parties.
What NOT READY is
NOT READY is an alarm clock with a drill-sergeant character, Sgt. Vex, who asks you to complete short bodyweight exercises (push-ups, squats and jumping jacks) when your alarm goes off. It also includes an optional guided Run 5K program with timed running and walking intervals. Vex is a fictional character. His insults are part of the act.
Your health
- NOT READY is for general fitness and entertainment. It is not medical advice and is not a substitute for advice from a doctor or qualified professional.
- Check with a doctor before starting any new exercise routine, especially if you have a health condition, an injury, are pregnant, or have not exercised in a long time.
- Stop immediately if you feel pain, dizziness, shortness of breath or discomfort. No streak is worth an injury.
- Make sure the space around you is clear and safe before you exercise. You are responsible for exercising within your own limits.
Alarms
We work hard to make alarms reliable, but they depend on your phone, its settings, its battery and iOS. Keep your phone charged and its volume and notification settings appropriate, and do not rely on NOT READY as your only alarm for anything where oversleeping could cause serious harm or loss.
Subscriptions and free trial
- Alarm scheduling and starting new runs require active Full Clearance access through a monthly or yearly subscription. There is no permanent free tier. The launch US prices are $7.99 billed monthly or $59.99 billed annually upfront. The actual local price, billing period and applicable offer are shown in the app and Apple's purchase sheet before you subscribe.
- Eligible subscribers can receive a 14-day (2-week) free trial. Apple determines eligibility; a returning subscriber is not guaranteed another trial. Unless you cancel at least 24 hours before the trial ends, the selected paid subscription starts and your Apple account is charged at the displayed renewal price.
- Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends.
- You can manage or cancel your subscription at any time in your iPhone's Settings, under your name, then Subscriptions. Deleting the app does not cancel it.
- Payments and refunds are handled by Apple under Apple's terms. To request a refund, visit reportaproblem.apple.com.
- If we change prices, Apple will notify you in advance as required, and you can cancel before the new price applies.
Subscription access and alarm scheduling
- Cancelling stops future renewal, not the access remaining in your current trial or paid period.
- During a trial, chosen weekdays are scheduled as fixed alarm dates before the verified trial expiry, up to 14 days ahead. No trial alarm is scheduled at or after that expiry, even when the app is closed.
- After the first payment, reopen the app with connectivity so it can verify paid access. Enabled trial weekday schedules can then continue as recurring alarms with the same times and orders. Disabled alarms stay disabled, and single-date alarms do not become recurring.
- Once paid access expires, new alarms and new runs are blocked when the app detects the expiry. Future paid recurring alarms are disabled on the next access check; they may continue to ring if the app remains closed and has not yet checked. Do not assume cancellation immediately removes an already-scheduled alarm.
- A run already in progress or wake-up exercise already underway can finish. An access expiry does not erase your saved progress or alarm definitions. Connectivity is required for purchases, restoration and fresh payment verification; valid cached access can support offline use.
Acceptable use
Use NOT READY for your own personal, non-commercial use. Do not copy, modify, reverse engineer or redistribute the app or its content, including Sgt. Vex's voice recordings, artwork and characters, except as allowed by law.
Our content
The NOT READY name, Sgt. Vex, the app, its audio, images and design belong to Psyche Vibes Ltd. Using the app gives you a personal, non-transferable licence to use it under these terms and Apple's standard licensed application end-user licence agreement.
Changes and availability
We may update, change or discontinue features of NOT READY. If we make material changes to these terms, we will update the date above and let you know in the app at least 30 days before they take effect. Continuing to use NOT READY after a change takes effect means you accept the updated terms. If you do not agree, stop using the app and cancel your subscription.
Your feedback
If you send us ideas, suggestions or feedback, we may use them freely to improve NOT READY, without owing you anything for them.
Suspension and termination
We may suspend or end your access to NOT READY if you seriously or repeatedly breach these terms, misuse the app, or if we are required to by law. Where reasonable we will tell you first. You can stop using NOT READY at any time by cancelling your subscription and deleting the app; your local progress is removed when you delete it. Sections on our content, liability and governing law continue to apply after termination.
Liability
NOT READY is provided "as is". To the extent the law allows, we are not liable for any indirect or consequential loss, or for injury resulting from exercising beyond your limits or ignoring the health guidance above. Otherwise, our total liability to you for any claim relating to NOT READY is limited to the amount you paid for it in the 12 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by our negligence, or your statutory rights as a consumer.
Governing law
These terms are governed by the laws of England and Wales. If you live elsewhere in the UK or in the EU, you also keep the protection of the mandatory consumer laws where you live.
General
These terms, together with our privacy policy, are the entire agreement between you and us about NOT READY. If a court finds any part of them unenforceable, the rest stays in effect. If we do not enforce a right straight away, we can still enforce it later.
